Terms of Service Agreement for Local Fish Member Application

Welcome to GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC (“the Platform” or “the Company”). By accessing or using the Platform, you acknowledge and agree to be bound by the terms and conditions set forth in this Terms of Service Agreement (“Agreement”). Please read this Agreement carefully before using the Platform.
1. Application Approval Process
1.1 Fishermen Membership: In order to become a member of the GetLocalFish.com platform, fishermen are required to submit an application for review by our internal team. Approval is subject to our vetting process to determine if the fisherman is a bona fide commercial entity and legally permitted to sell their catch.
1.2 Exclusivity: GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, does not work with recreational fishermen as it is illegal to sell sport-caught fish. Therefore, only commercial fishermen meeting the eligibility criteria will be approved for membership.
2. Fishermen Application Requirements
2.1 Commercial Fishing License: Fishermen must possess an appropriate Commercial Fishing License ID in the format of L_ _ _ _ _ as a requirement for application submission.
2.2 Fish and Wildlife Boat Number: Fishermen must provide their Fish and Wildlife Boat Number in the format of FG_ _ _ _ _ to complete the application process.
2.3 USCG Fishing Vessel Safety Certification Exam: GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, collaborates with the United States Coast Guard (USCG) to ensure safety standards are met. Fishermen’s vessels must have successfully passed the USCG Fishing Vessel Safety Certification Exam.
3. Compliance with Laws and Regulations
3.1 By using the Platform, fishermen represent and warrant that they will comply with all applicable laws, regulations, and licensing requirements related to commercial fishing and the sale of their catch.
3.2 GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, reserves the right to verify and monitor fishermen’s compliance with applicable laws and regulations.
4. Termination of Membership
4.1 GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, reserves the right to suspend or terminate a fisherman’s membership if it is determined that they have provided false or misleading information during the application process or if they are found to be in violation of any applicable laws or regulations.
4.2 Fishermen may also request the termination of their membership by contacting GetLocalFish.com.
5. Privacy and Data Protection

Local Fish encourages all fishermen to adopt this set of industry standards to lead by example for the fishing community in San Diego.

In addition to the Guiding Principles, GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, encourages fishermen to adhere to Local Fish’s “Ocean Stewardship Standards” to be a good steward of the ocean and ensure there are fish stocks available for future generations of fishermen.
6.2.1. Adhering to State and Federal Fishing Regulations: Ensure strict compliance with both state and federal fishing regulations and actively participate in initiatives aimed at improving management systems.

7. Modifications to the Agreement
7.1 GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, reserves the right to modify or update this Agreement at any time. Any changes will be effective upon posting the revised Agreement on the Platform. By continuing to use the Platform after such changes, fishermen agree to be bound by the updated terms and conditions.
8. Governing Law and Jurisdiction
8.1 This Agreement shall be governed by and construed in accordance with the laws of California. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in California.
9. Limitation of Liability
9.1 GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, and its affiliates, directors, officers, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the Platform or any transactions conducted through the Platform.
9.2 GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, makes no warranties or representations, express or implied, regarding the accuracy, reliability, or completeness of any information or content provided through the Platform.
9.3 Fishermen acknowledge and agree that they assume full responsibility for any risks associated with the use of the Platform, including but not limited to the purchase and sale of seafood products.
9.4 GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, shall not be responsible for any losses, damages, or liabilities incurred as a result of actions taken or decisions made based on information or content obtained through the Platform.
9.5 Fishermen agree to indemnify and hold GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, harmless from any claims, losses, damages, liabilities, costs, or expenses (including attorney’s fees) arising out of or in connection with their use of the Platform or any breach of this Agreement.
By accessing or using the GetLocalFish.com Platform, you acknowledge that you have read, understood, and agree to be bound by this Terms of Service Agreement. If you do not agree with any provision of this Agreement, please refrain from using the Platform.

4. Termination of Membership
4.1 GetLocalFish.com, operated by Local Fish, a division of Saraspe Seafoods LLC, reserves the right to suspend or terminate a chef’s membership if they are found to be in violation of any applicable laws or regulations or if they do not uphold the commitment to sustainable seafood practices and local sourcing.
4.2 Chefs may also request the termination of their membership by contacting GetLocalFish.com.
